Terms and Conditions – Epic Kiwi Tours

By booking, purchasing, or participating in any tour or service operated by Epic Kiwi Tours, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions.

1. Booking & Confirmation

1.1 All bookings are subject to availability and are only considered confirmed once accepted by Epic Kiwi Tours.
1.2 Travel agent vouchers, third-party vouchers, or electronic tickets are not valid unless confirmed directly by Epic Kiwi Tours.
1.3 Tours must commence on the date specified at the time of booking unless otherwise agreed in writing.

2. Prices & Currency

2.1 All prices are quoted in New Zealand Dollars (NZD) unless stated otherwise.
2.2 Epic Kiwi Tours reserves the right to amend prices at any time prior to booking confirmation.

3. Passenger Categories

3.1 Child fares apply to passengers aged 3 to 12 years.
3.2 Infants are defined as 0 to 2 years of age.
3.3 Airline Crew Special fares require presentation of a valid Aircrew ID at the time of travel. Failure to present valid identification may result in the fare being adjusted.

4. Changes to Bookings

4.1 Any request to amend a booking must be made at least 24 hours prior to departure.
4.2 Changes are subject to availability and may incur additional charges.

5. Cancellation Policy – Group Tours

If you cancel a confirmed Group Tour, the following cancellation fees apply (calculated on the total booking value):

• 7–10 days before departure: 25%

• 3–6 days before departure: 50%

• 48 hours or less before departure: 100% (no refund)

6. Cancellation Policy – Private Tours

If you cancel a confirmed Private Tour, the following cancellation fees apply:

• 7–10 days before departure: 25%

• 4–6 days before departure: 50%

• 72 hours or less before departure: 100% (no refund)

All refunds, where applicable, are issued at the sole discretion of Epic Kiwi Tours.

7. Tour Operations & Itinerary Changes

7.1 Epic Kiwi Tours reserves the right to alter routes, schedules, fares, inclusions, vehicles, accommodation providers, or tour services at any time without prior notice.
7.2 Substitute vehicles or third-party operators may be used where necessary.
7.3 Advertised inclusions and accommodation are indicative only and cannot be guaranteed.

8. Minimum Numbers

8.1 All tours are subject to minimum passenger numbers.
8.2 If minimum numbers are not met, Epic Kiwi Tours reserves the right to cancel the tour. Alternative arrangements or options will be offered where possible.

9. Delays & Schedule Variations

9.1 While every effort is made to operate tours as scheduled, Epic Kiwi Tours is not responsible for delays, missed connections, or cancellations caused by weather, road conditions, mechanical issues, or circumstances beyond its control.

10. Liability & Risk

10.1 Participation in tours involves inherent risks. To the maximum extent permitted by law, Epic Kiwi Tours shall not be liable for any injury, illness, death, loss, damage, delay, or expense suffered by any passenger.
10.2 This limitation applies whether the loss arises from negligence or otherwise.

11. Personal Property & Insurance

11.1 Passengers are responsible for their own personal belongings at all times.
11.2 Epic Kiwi Tours does not provide travel insurance and strongly recommends that all passengers obtain comprehensive travel insurance covering medical expenses, cancellations, loss, and personal injury.

12. Third-Party Services

12.1 Where services are provided by independent third-party operators, Epic Kiwi Tours acts only as an agent and accepts no responsibility for the acts, omissions, or defaults of those operators.

13. Indemnity

You agree to indemnify and hold harmless Epic Kiwi Tours, its directors, employees, agents, and contractors against any claim, loss, damage, or expense arising from your actions, omissions, or breach of these Terms and Conditions.

14. Force Majeure

Epic Kiwi Tours shall not be liable for failure or delay in performing its obligations where such failure arises from events beyond its reasonable control, including but not limited to natural disasters, government actions, strikes, or adverse weather conditions.

15. Amendments

Epic Kiwi Tours may revise these Terms and Conditions at any time without prior notice. The version in effect at the time of booking will apply.

16. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993.
